CRIMINAL DEFENSE

 

The attorneys of SARIA & SARIA have extensive experience in representing clients facing serious and violent felonies to include homicide, kidnapping, conspiracy, felonious assaults, weapon offenses, major narcotic violations, aggravated white collar crimes, governmental conflict of interest violations, insurance fraud, and Third Strike cases.

 

MENTAL HEALTH LITIGATION

SARIA & SARIA represents clients under the jurisdiction of the California Department of State Hospitals who are involuntarily committed to state hospitals.  These clients have been determined to be either Mentally Disordered Offenders, Not Guilty by Reason of Insanity, Incompetent, or Sexually Violent Offenders.  Representation may include initial trial proceedings, annual reviews, or extension proceedings.

 

WRITS & APPEALS

SARIA & SARIA has appeared before the appellate courts in both writ proceedings and direct appeals.  Client representation has also included writ proceedings before the Superior Courts when extraordinary relief is appropriate.

 

ADMINISTRATIVE LAW

SARIA & SARIA has represented clients before the California Office of Administrative Hearings in matters concerning the Department of Motor Vehicles, California State Contractor's Licensing Board, Department of Social Services, and others when the client's license to practice a profession has been challenged.

 

EXPUNGEMENTS

 

Individuals who have been convicted of crimes and who have successfully completed probation and paid all fines, fees, and restitution may have the right to petition a court to remove their convictions from their criminal records. Expungement of past convictions can help in employment, educational, and other endeavors. Some individuals may also qualify for a reduction of old felony convictions to misdemeanors under Proposition 47 (non-violent theft) or Proposition 64 (marijuana).

 

REPRESENTING SERVICE MEMBERS

 

For active duty service members and military veterans who are charged with crimes in civilian court, SARIA & SARIA can coordinate with the Department of Veteran Affairs (VA) to ensure that benefits are available for use in a criminal defense. We can also represent service members and veterans in military criminal proceedings. We are experienced in navigating the bureaucracy of the Department of Defense and the individual uniform services to obtain relevant military records. We strive for minimal impact upon an individual’s military career.
